Protection against moral harassment at work place

The law of March 29, 2023 introduced into the labour code provisions sanctioning moral harassment in working relationships.

The new law targets any repetitive or systematic behaviour affecting the physical or psychological integrity or dignity of a person, also outside normal (regular) working hours.

It bans the behaviour arising not only of an employee or employer but also of a customer or supplier of a company.

The employer is responsible for stopping all harassment immediately. Each company must define its internal rules of procedure in order to avoid and deal with cases of harassment.

The ITM has jurisdiction and is competent to investigate harassment cases.

No victim nor witness of any harassment situation may be subject to any punishment or have it’s contract terminated.
